Influencer Terms of Service

These Influencer Terms of Service (“Terms”) govern participation in the PAIGOS platform (“Paigos,” “Platform,” “Service”) as an Influencer. By accessing or using the Platform as an Influencer, you agree to be bound by these Terms.

1. Overview & Acceptance

Who Is an Influencer

An Influencer (“you”) is an individual who shares travel-related content and promotes curated travel packages through their own PAIGOS storefront. Influencers collaborate with vetted suppliers to co-create and promote partnered travel packages.

Influencers:

  • Assist with marketing and promotion only

  • Are not responsible for travel fulfillment or logistics

  • Earn commissions based on bookings generated through their storefront

Acceptance of Terms

By using PAIGOS as an Influencer, you confirm that you have read, understood, and agreed to these Terms and any related policies. If you do not agree, you may not participate as an Influencer.

Age & Authority

You represent that you are at least 18 years old (or the age of majority in your jurisdiction) and have legal authority to enter into this agreement.

2. Account Creation & Onboarding

Account Security

You are responsible for safeguarding your account credentials. All activity under your account is considered authorized unless you notify PAIGOS of suspected unauthorized use.

Accurate Information

All information you provide must be truthful, accurate, and current. PAIGOS reserves the right to suspend or terminate accounts with false or misleading information.

3. Marketing & Promotions

Influencer Communications

You may promote PAIGOS packages through:

  • Personal social media channels

  • Approved marketing outlets

Where required by law or platform rules, you agree to clearly disclose your role as an Influencer.

Use of AI Tools

PAIGOS may use AI tools to help draft or distribute communication templates. You remain fully responsible for the accuracy and legality of all content you publish or share.

Marketing Materials License

By providing marketing materials (images, copy, branding assets), you grant PAIGOS a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute those materials in connection with operating and marketing the Platform.

4. Payments, Fees & Commissions

Transaction Processing

  • PAIGOS or its third-party payment processors handle traveler payments and refunds

  • You agree to comply with payment processor requirements, including tax documentation

Payouts

  • Payouts occur after a traveler’s booking is completed and payment is captured

  • Payments are issued according to the schedule displayed on the Platform

  • Applicable fees or commissions are deducted prior to payout

  • Influencers are responsible for all applicable taxes

  • Commission rates are determined by PAIGOS tier classifications

5. Intellectual Property & Data Usage

Influencer Content License

By posting or sharing content that references PAIGOS packages (including affiliate links), you grant PAIGOS a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use that content for marketing, promotion, and display across PAIGOS websites, apps, email campaigns, and social channels.

Platform Intellectual Property

All PAIGOS trademarks, logos, and proprietary materials belong to PAIGOS or its licensors. You may not use PAIGOS branding without prior written permission.

Publicly Available Data

PAIGOS may reference publicly available Influencer content (including social posts) for marketing or demonstration purposes. Participation as an Influencer constitutes acceptance of this usage unless otherwise agreed in writing.

6. Termination & Account Management

Termination by PAIGOS

PAIGOS may suspend or terminate your account if you:

  • Violate these Terms

  • Engage in fraud

  • Receive repeated negative claims

  • Harm the Platform or its users

Outstanding payments will be handled according to these Terms, minus amounts needed for refunds or dispute resolution.

Termination by You

You may request account termination by emailing admin@paigos.com. Requests to disconnect your name from a supplier or package must be submitted through PAIGOS administration.

7. Disclaimers & Limitation of Liability

Disclaimer of Warranties

The PAIGOS Platform is provided “as is” and “as available.” PAIGOS makes no guarantees regarding reliability, bookings, or earnings.

Limitation of Liability

To the fullest extent permitted by law:

  • PAIGOS is not liable for indirect, incidental, special, or consequential damages

  • Total liability will not exceed the fees collected by PAIGOS related to the disputed transaction

8. Dispute Resolution & Governing Law

Arbitration Agreement

All disputes must be resolved by binding arbitration, except eligible small-claims matters.

Rules & Location

  • Administered by the American Arbitration Association (AAA)

  • Governed by the Federal Arbitration Act (FAA)

  • Arbitration location: Orange County, California

Class Action & Jury Waiver

You waive the right to:

  • Participate in class or collective actions

  • Trial by jury

Governing Law

California law governs these Terms, except where federal arbitration law applies.

9. Compliance With Laws

You agree to comply with:

  • Consumer protection and advertising laws

  • Disclosure requirements for influencer promotions

  • All applicable tax obligations (income, VAT, sales tax, etc.)

10. Changes to These Terms

PAIGOS may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance. Material changes will be communicated via email or Platform notice.

12. Acknowledgment

By clicking “I agree”, you confirm that you have read, understood, and accepted these Terms. If you do not agree, you must discontinue participation on the Platform.
